Terms of Service

These terms govern your use of Cachely (the "Service"), operated by the Cachely maintainers ("we", "us"). By creating an account, using the dashboard, or pushing artifacts to the cache, you agree to these terms. If you do not agree, do not use the Service.
For anything that is not covered below, or before relying on the Service for a production workload, please contact us at hello@cachely.dev so we can agree separate terms in writing.
Beta service
The Service is currently in beta. Features may change, break, or be removed, and the Service may be unavailable from time to time. We will give as much warning as we can for anything that affects existing workspaces, but we do not promise uptime, performance, or backwards compatibility during the beta. No service-level agreement applies unless we have signed one with you.
Because we are in beta, we may introduce, change, reduce, or remove usage limits, quotas, plan caps, and rate limits at any time, including for the free tier and including with immediate effect where needed to protect the Service, control our costs, or prevent abuse. We will give reasonable notice of material reductions that affect your existing usage where we practically can, but we may apply changes without advance notice in cases of abuse, security risk, or runaway cost. If a workspace exceeds an applicable limit, the cache may stop storing or serving artifacts for that workspace until usage is back within the limit, and your build tooling will simply fall back to rebuilding.
Eligibility and accounts
You must be at least 16 years old and able to enter into a binding contract to use the Service. You are responsible for keeping your account credentials and API tokens secret, for everything done under your account or tokens, and for keeping the contact email on your account current.
Acceptable use
You agree not to:
- store or distribute malware, illegal content, child sexual abuse material, or content that infringes a third party's rights;
- use the Service to send unsolicited communications or to facilitate phishing, fraud, or harassment;
- attempt to access, probe, or test the vulnerability of the Service except through a coordinated disclosure to us;
- interfere with, overload, or circumvent quotas or rate limits, or use the Service to attack any system;
- reverse engineer or resell the Service, or use it to build a directly competing product;
- use the Service in violation of any applicable law or export control.
We may suspend or terminate access immediately if we reasonably believe you are violating this section, if we are required to do so by law, or if your usage is putting the Service or other users at risk.
Your content
You retain all rights to the build artifacts and other content you upload ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free licence to host, copy, transmit, and process Your Content solely as needed to provide and secure the Service. We do not claim ownership of Your Content and do not use it to train models or for any unrelated purpose.
You are responsible for Your Content, including for the lawful right to upload it and to grant the licence above. Do not upload secrets, personal data, or anything you are not allowed to share. Treat the cache as a build artifact store, not a secrets store.
Our intellectual property
The Service, including the Cachely name, logo, website, dashboard, documentation, and source code that we choose to keep proprietary, are owned by us or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service in line with these terms.
Trademarks
Nx is a trademark of Narwhal Technologies Inc. Turborepo and Vercel are trademarks of Vercel, Inc. Bazel is a trademark of Google LLC. All other product names, logos, and brands are the property of their respective owners. Cachely is an independent project and is not affiliated with, endorsed by, or sponsored by any of them. We reference these names only to describe interoperability and for comparison.
Third-party services
The Service is built on infrastructure provided by Cloudflare and uses Google for authentication. Your use of the Service depends on those services and is also subject to their terms. We are not responsible for outages, changes, or actions of third-party providers.
Fees
The beta is currently offered free of charge. We will give you notice before introducing fees that affect your workspace, and you will have the opportunity to export your data or close your account before any paid plan starts.
Termination
You can close your account at any time by emailing hello@cachely.dev from the address on file. We can suspend or terminate your access at any time, with or without notice, in particular for breach of these terms or if we discontinue the Service. On termination your right to use the Service ends; sections of these terms that by their nature should survive (intellectual property, disclaimers, limitation of liability, indemnity, miscellaneous) will survive.
Disclaimer of warranties
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, or that the Service will be uninterrupted, error-free, or secure. You use the Service at your own risk.
Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, even if we have been advised of the possibility of such damages. Our total aggregate liability arising out of or relating to the Service or these terms will not exceed the greater of (a) the fees you paid us in the twelve months before the claim, or (b) one hundred US dollars (USD 100).
Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded.
Indemnity
You agree to indemnify and hold us harmless from any claim, loss, or expense (including reasonable legal fees) arising out of Your Content, your use of the Service, or your breach of these terms or of any applicable law, except to the extent caused by our own gross negligence or wilful misconduct.
Privacy
Our handling of personal data is described in our Privacy Policy, which forms part of these terms.
Changes to these terms
We may update these terms from time to time. If we make material changes we will give you reasonable notice (for example, by email to your workspace owner or by a prominent notice in the dashboard). Continued use of the Service after the changes take effect means you accept the new terms.
Governing law
We are not yet incorporated, so we do not impose a single choice of law on you. Where applicable law gives you mandatory consumer protection in your country of residence, those rights apply. If you need a specific governing-law and forum agreement for procurement, please contact us so we can put one in place before you adopt the Service in production.
Miscellaneous
These terms are the entire agreement between you and us regarding the Service and supersede any prior agreement on the same subject. If any provision is held unenforceable, the rest will remain in effect. Our failure to enforce a right is not a waiver. You may not assign these terms without our written consent; we may assign them to a successor entity (for example, on incorporation) on notice to you.
